1. Agreement to these terms

These Terms of Service (“Terms”) govern your access to and use of apexalign.co and any application you submit through it. By using the site or submitting an application, you agree to these Terms. If you do not agree, please do not use the site.

“We”, “us” and “our” mean Apex Align Agency. “You” means the person using the site or applying for a partnership.

2. What we provide

We design structured revenue systems around the expertise of technical professionals and execute growth initiatives under a commission-based agreement. This website is informational: it describes our model, publishes indicative outcomes, and lets you apply to work with us.

Using the site does not create a partnership, agency relationship, employment relationship, joint venture or fiduciary relationship between us. A partnership begins only when both parties sign a written agreement.

3. Eligibility

You must be at least 18 years old and able to enter into a binding contract to apply. Our model is built for US and EU-based technical professionals; it is not an employment placement service, and it is not intended for founders or agencies seeking client acquisition. We may decline any application at our discretion and are not required to give a reason.

4. Applications and the information you submit

When you apply, you agree that the information you provide is accurate, current and yours to share, and that you are not impersonating anyone or breaching an obligation to a current employer or client by contacting us.

Submitting an application places no obligation on either side. We handle the information you send us as described in our Privacy Policy.

5. The partnership agreement controls

If we work together, a separate written partnership agreement will set out the commercial terms: scope, commission percentages, payment flows, reporting, confidentiality, intellectual property, notice periods and termination.

That agreement takes precedence over anything on this website. Where these Terms and a signed partnership agreement conflict, the signed agreement governs the subject it covers.

6. No income guarantee and no professional advice

Any figures, ranges or timelines shown on this site — including monthly income ranges by time commitment and typical ramp periods — are illustrative of what some partners have reached. They are not a promise, projection or guarantee of what you will earn.

Results depend on market demand, skill level, positioning, the hours you commit and your own execution, and they vary between individuals. Nothing on this site is legal, tax, financial, accounting, immigration or employment advice. Consult your own qualified advisors before making decisions, including about how a partnership interacts with your current employment.

7. Acceptable use

You agree not to:

• Use the site for any unlawful, deceptive or infringing purpose
• Submit false, misleading or someone else's information
• Attempt to gain unauthorised access to the site, its infrastructure or any related systems
• Interfere with the site's operation, including by scraping, flooding the application form, or introducing malicious code
• Copy, resell or republish our content, frameworks or materials without written permission

We may suspend or block access to the site if we reasonably believe these rules have been broken.

8. Intellectual property

The site and its content — text, design, logos, graphics and the frameworks and methodology we describe — belong to Apex Align Agency or our licensors and are protected by intellectual property laws. You may view and share the pages for your own evaluation of our services. Any other use, including reproduction or the creation of derivative works, requires our prior written consent. Ownership of work product created during a partnership is set out in the partnership agreement.

9. Third-party services and links

The site relies on third-party services (for example, form delivery and hosting) and links to third-party sites such as LinkedIn and payment providers. We do not control those services, we are not responsible for their content or availability, and their own terms and policies apply to your use of them.

10. Disclaimer of warranties

The site is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the site will be uninterrupted, error-free or secure, or that the information on it is complete or current at all times. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

11. Limitation of liability

To the fullest extent permitted by law, Apex Align Agency and its team will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost income, lost business opportunities or lost data, arising from your use of the site or reliance on its content. Our total liability for any claim relating to the site is limited to the greater of the amounts you have paid us in connection with the site (which, for the site itself, is nil) or USD 100. Nothing in these Terms excludes liability that cannot lawfully be excluded, including for fraud, death or personal injury caused by negligence.

12. Indemnity

You agree to indemnify and hold harmless Apex Align Agency against claims, losses and reasonable costs (including legal fees) arising from your breach of these Terms, your misuse of the site, or your violation of any law or third-party right.

13. Termination

We may modify, suspend or discontinue any part of the site, or your access to it, at any time and without notice. Sections that by their nature should survive — intellectual property, disclaimers, limitation of liability, indemnity and governing law — continue to apply after access ends. Termination of an active partnership is governed by the notice and exit terms in the partnership agreement, not by this section.

14. Changes to these terms

We may update these Terms from time to time. The current version is always posted on this page with its “last updated” date, and it takes effect when posted. Continuing to use the site after a change means you accept the revised Terms.

15. Governing law and disputes

These Terms and any dispute arising from them or from your use of the site are governed by the laws of the jurisdiction in which Apex Align Agency is established, without regard to conflict-of-laws rules. The courts of that jurisdiction have exclusive jurisdiction, except where mandatory consumer protection law gives you the right to bring proceedings where you live.
