1. Who we are
Apex Align Agency (“we”, “us”, “our”) is a performance-based growth partner for technical professionals in the US and EU. This policy explains what personal information we collect through apexalign.co, why we collect it, who we share it with, and the choices you have.
It applies to visitors of our website, people who apply for a partnership, and partners we work with under a signed agreement. For data protection questions you can reach us at justin@apexalign.co.
2. Information we collect
Information you give us
When you submit the partnership application form on our site, we collect the details you enter:
- Your name
- Your email address
- Your country
- Your LinkedIn profile URL (optional)
- The message and any background you choose to share with us
If you email us directly, we receive whatever you include in that correspondence.
Information from an active partnership
If we enter into a partnership, we process the information needed to run it: contract and identity details, professional background and positioning materials, communications, revenue and commission records, and the payout details required by our payment providers.
Information collected automatically
Like most websites, our hosting infrastructure records technical data when you visit — IP address, browser and device type, referring page, and the pages you request — for security, abuse prevention and reliability. See our Cookie Policy for what is stored in your browser.
We do not ask for and do not want special category data (such as health, political or biometric information). Please do not include it in your application.
3. How we use your information
We use personal information to:
- Review and respond to partnership applications
- Communicate with you about your application, our model and next steps
- Negotiate, enter into and perform partnership agreements
- Design, operate and track the revenue systems we build together
- Calculate and pay commissions, and keep the associated financial records
- Keep our site secure, prevent abuse and diagnose technical problems
- Meet legal, tax and accounting obligations, and establish or defend legal claims
We do not sell your personal information, and we do not share it with third parties for their own advertising.
4. Legal bases for processing (EEA/UK)
If you are in the European Economic Area or the United Kingdom, we rely on the following legal bases under the GDPR:
- Performance of a contract — to evaluate your application at your request and to carry out a partnership agreement.
- Legitimate interests — to run and secure our business, respond to enquiries, and keep records of our dealings, balanced against your rights.
- Legal obligation — to satisfy tax, accounting and other statutory requirements.
- Consent — where we ask for it, for example for optional marketing messages. You can withdraw consent at any time.
6. International transfers
We work with professionals and providers in both the US and the EU, so your information may be transferred to and processed in a country other than your own. Where we transfer personal data out of the EEA or UK, we rely on an adequacy decision or on Standard Contractual Clauses together with additional safeguards where needed. You can ask us for details of the mechanism used.
7. How long we keep it
We keep personal information only as long as we need it for the purpose it was collected:
- Applications that do not lead to a partnership: up to 24 months, so we can revisit a fit later, unless you ask us to delete them sooner.
- Partnership records, contracts and financial data: for the life of the partnership and then for the period required by tax, accounting and limitation laws.
- General correspondence: as long as needed to handle the matter and keep a reasonable record of it.
8. Security
We use access controls, encryption in transit, reputable service providers and a need-to-know approach within our team to protect personal information. No method of transmission or storage is completely secure, so we cannot guarantee absolute security — but if a breach affects your information, we will notify you and the relevant authority where the law requires it.
9. Your rights and choices
Depending on where you live, you may have the right to:
- Access the personal information we hold about you and receive a copy of it
- Correct information that is inaccurate or incomplete
- Delete information we no longer have grounds to keep
- Restrict or object to certain processing, including processing based on legitimate interests
- Receive your data in a portable format, or have it transmitted to another controller
- Withdraw consent at any time, without affecting processing already carried out
- Be free from discrimination for exercising any of these rights
To exercise any of these, email justin@apexalign.co. We will verify your request and respond within the period the applicable law allows. If you are in the EEA or UK, you may also complain to your local supervisory authority; if you are a California resident, note that we do not sell or share personal information as those terms are defined by the CCPA/CPRA.
10. Children
Our services are intended for working professionals and are not directed to anyone under 18. We do not knowingly collect information from children. If you believe a child has provided us with personal information, contact us and we will delete it.
11. Third-party links
Our site links to third-party services such as LinkedIn and document hosting. Those services are controlled by others and have their own privacy policies. We are not responsible for their practices, and we encourage you to read their terms before sharing information with them.
12. Changes to this policy
We may update this policy as our business, tooling or legal obligations change. The revised version will be posted on this page with a new “last updated” date. If the changes are significant, we will take reasonable steps to notify applicants and partners directly.
